SOCIAL SECURITY CONTRIBUTIONS NOW INCLUDED IN TANZANIA’S SUMMARY SUIT LIST.

The government of Tanzania has broadened suit under summary procedure to include suits for recovery of social security contributions or additional contributions due to social security schemes. The amendment was done through the Civil Procedure Code (Amendment of the First Schedule) Rules, 2025, announced in Government Notice No. 569 published on 12/9/2025.


There is no automatic right to appear in suit relating with social security contributions or additional contributions due to social security schemes. The defendant is required to obtains leave from the judge or magistrate so to appear and defend. However, before leave is granted to appear and defend the suit, the defendant is now required to deposit a sum equal to fifty percent of the social security contributions or additional contributions claimed or to furnish security of a value not less than fifty percent of the contributions claimed.


Failure to obtain leave and defend, the allegations in the plaint shall be deemed to be admitted and social security schemes shall be entitled to:

  • to a decree for any sum not exceeding the sum mentioned in the summons,
  • interest at the rate specified (if any) and
  • such sum for costs as may be prescribed, unless the plaintiff claims more than such fixed sum, in which case the costs shall be ascertained in the ordinary way, and such decree may be executed forthwith.
